To facilitate transportation activities... MOU signed between Transport General Authority and SCCA
Published Date: 31/07/2022
In an effort to further the Saudi ground, maritime, and rail transportation sector and to facilitate the activities of businesses operating in Saudi Arabia, the Saudi Center for Commercial Arbitration (SCCA) and the Transport General Authority (TGA) signed a memorandum of understanding, thus establishing channels of cooperation between the two organizations in order to serve businesses operating in the sector through a package of institutional arbitration and mediation solutions and raise business owners’ awareness of alternative dispute resolution (ADR).
The MOU signing ceremony took place at TGA headquarters in Riyadh today. The TGA was represented by its vice president for the Operations and Digital Transformation Section and the acting president, Eng. Fahd Bin Sulaiman Al-Baddah, while SCCA was represented by CEO Dr. Hamed Bin Hassan Merah.
The conclusion of this MOU establishes a framework for SCCA and TGA to cooperate in facilitating dispute resolution in the Saudi ground, maritime, and rail transportation sector. Businesses in the sector will be provided with insight into the role ADR can play in facilitating business activities through the inclusion of a dispute resolution clause in commercial contracts and access to the solutions SCCA offers for achieving justice.
There are several areas in which TGA and SCCA can cooperate, foremost among them being the addition of provisions to the regulations governing transportation activities to promote recourse to institutional arbitration, the study of procedural rules that could be instituted for the resolution of disputes in the sector, and awareness-raising among transportation businesses about the optimal wording of dispute resolution clauses.
The MOU will help create the right environment for parties with contractual relationships in the transportation sector to resolve their disputes through institutional arbitration and mediation, establishing a special track to resolve such dispute through SCCA when necessary. SCCA will also contribute to TGA staff development with a package of ADR-related training programs. The two organizations will cooperate through awareness-raising, holding joint events, and exchanging data for the preparations of relevant studies.
