Mediation Rules

The SCCA Mediation Rules development process:

 

• SCCA Board of Directors  decided that the SCCA Mediation Rules decided would be based upon the AAA-ICDR Mediation Rules due to the wide broad success they achieved worldwide, flexibility and ease of implementation;
• A drafting joint team (the “Team”) was formed with SCCA and consultants from AAA-ICDR to draft the SCCA Mediation Rules;
• The Team prepared the first draft of the SCCA Mediation Rules taking into account some modifications to articles and terminology to be more suitable for the local and regional market. while , creating a systematic, flexible  and cost effective framework .
• Mediation under the SCCA Mediation Rules is a flexible procedure aimed at facilitating and achieving a negotiated settlement through a neutral third party conducting the mediation meeting(s) - yet without having the authority to make a binding decision or award;
• SCCA organized several workshops to discuss its  draft Mediation Rules with lawyers as well as two workshops with its Board of Directors;
• The Team modified the draft SCCA Mediation Rules in the light of the substantive discussions that took a place during the workshops. The SCCA Board of Directors then approved the SCCA Mediation Rules.
• The SCCA Board of Directors then approved the SCCA Mediation Rules.
