The SCCA Committee for Administrative Decisions held its first two sessions to determine arbitrator challenges

The Saudi Center for Commercial Arbitration (SCCA) has launched the SCCA Committee for Administrative Decisions (SCCA-CAD) to provides parties with access to a decision-making authority that make swift and effective decisions to resolve impasses and move an arbitration forward.

 

Its scope is limited to the determination of (1) arbitrator challenges, (2) disputes concerning the place of arbitration, and (3) disputes concerning the number of arbitrators in SCCA-administered as well as non-SCCA-administered (ad hoc) arbitration proceedings.

 

SCCA-CAD is composed of high-level executives at the SCCA and external internationally recognized neutral arbitration experts with time-tested experience in administration and decision-making processes of some of the world's most prominent arbitral institutions.

 

SCCA-CAD has a minimum of five members, of which three voting members will hear and determine any motions on a weekly or ad hoc basis in case of an emergency. Determinations will be made by majority vote based on party submissions.

 

The Committee's current members are:

  • Dr. Mohamed Abdel Raouf: International Arbitrator, Partner and Head of the international arbitration group at Abdel Raouf Law Firm (Cairo), Associate Professor at the University of Paris 1 Panthéon -Sorbonne, former Director of the Cairo Regional Centre for International Commercial Arbitration (CRCICA).Prof. Dr. Mohamed Abdel-Raouf - International Arbitrator, Partner and Head of Abdel Raouf Law Firm (Cairo); former Secretary General of the Cairo Regional Center for International Commercial Arbitration (CRICRA).
  • Ms. Jennifer Kirby: International Arbitrator, Principal of Kirby (Paris); former Deputy Secretary General of the ICC International Court of Arbitration.
  • Mr. Christian P. Alberti: Chief of ADR and General Counsel of SCCA, Riyadh; former Assistant Vice President at the International Centre for Dispute Resolution (AAA-ICDR).
  • Two additional SCCA Executives.

 

SCCA-CAD has already held various meetings and decided a total of three challenges with differing outcomes. It provides its services free of charge for SCCA-administered cases, and at reasonable service fee for non-SCCA-administered (ad hoc) cases.

 

Since its founding, the SCCA has devised a methodology compatible with current and best international practices in alternative dispute resolution, the application of governance standards, the worldwide scope of SCCA and its team as well as the promotion of neutrality, independence, and institutionalization – all of which is embodied in the establishment of SCCA-CAD.
