Arbitration Case Management & Mediation in Commercial Disputes

The Saudi Center for Commercial Arbitration (SCCA) has recently launched one of its training activities through holding two intensive programs in collaboration with its strategic partner, the International Centre for Dispute Resolution of the American Arbitration Association (AAA-ICDR) at its headquarters in Council of Saudi Chambers in Riyadh. The first program was titled "Advanced Arbitration Case Management Techniques" which lasted for two days, and the second program was titled "Mediation in Commercial Disputes" which lasted for three days.

Both programs were the first of their kind in the Kingdom, through providing two intensive programs for alternative dispute resolutions in one week. Both programs were attended by a number of experienced lawyers working in arbitration, international lawyers and those interesting in mediation and arbitration. They were presented in both Arabic and English and accompanied by simultaneous interpretation.

The Advanced Arbitration Case Management Techniques was provided by Dr. Mostafa Abdel Ghaffar, Head of Dispute Resolution Department, Dr. Mohamed Abdel Raouf, an arbitrator, Lawyer and former Secretary-General of the Cairo Regional Center for International Commercial Arbitration and Mr. Richard Naimark, Senior Vice-President of the International Centre for Dispute Resolution  of the American Arbitration Association (AAA-ICDR).

The program of Mediation in Commercial Disputes was provided by Mr. James McPherson, Adviser to the Saudi Center for Commercial Arbitration and an international mediator, Mr. Mark Appel, an arbitrator, mediator and Senior Vice-President of the International Centre for Dispute Resolution of the American Arbitration Association (AAA-ICDR), Dr. Mohamed Abdel Raouf, Mr. Richard Naimark and Dr. Mostafa Abdel Ghaffar, Head of Dispute Resolution Department.

It is worth noting that the Program of "Advanced Arbitration Case Management Techniques" was presented in a practical way through studying a hypothetical case from its initiating to the issuance of the arbitral award. It also discussed all stages of the case in accordance with the arbitration rules of the Saudi Center for Commercial Arbitration published on its website www.sadr.org. The participants discussed the condition of both local and international institutional arbitration industry, the available opportunities and potential challenges of institutional arbitration in the Kingdom. They compared the practices related to procedure management between free and institutional arbitration that saves time and cost, raises the level of practice in this field and acquires business confidence in the arbitration industry.
