Agenda

Presented by SCCA and the Capital Market Authority in collaboration with the US Department of Commerce’s Commercial Law Development Program (CLDP) and the American Financial Industry Regulatory Authority (FINRA), sponcered by the Council of Saudi Chambers. 

The program aims to explore the role of alternative dispute resolutions (Arbitration and Mediation) in developing regulatory framework and fast disputes settlements, minimizing the number of cases in the capital market ensuring greater reliability of contract compliance and enforcement. The program also explores the FINRA experience on alternative dispute resolution in the financial industry.

About the Speakers:

Kenneth Andrichik:

Kenneth L. Andrichik is Senior Vice President, Chief Counsel and Director of Mediation and Strategy for FINRA Dispute Resolution. Mr. Andrichik developed the first full-scale mediation program in the securities industry, and is responsible for expanding FINRA's dispute resolution services internationally. He began his career in 1980 in the Surveillance and Anti-Fraud Divisions of the National Association of Securities Dealers, Inc. (NASD). Between 1985 and 1990, he opened and managed the Midwest Regional Arbitration Office for the NASD. In 1990 he became the Deputy Director of the Arbitration Department, responsible for the operation of the largest dispute resolution forum in the securities industry. He has spoken extensively on securities arbitration and mediation, conducted arbitrator and mediator training seminars around the country, and published several articles on securities dispute resolution. Mr Andrichik serves on FINRA's Diversity Leadership Council. He earned his degree in Finance from the University of Illinois and his law degree from Loyola University in Chicago.

 

James Macpherson:

A bilingual (English/French) international ADR Expert with 25 years’ experience with public and private sector clients, including retained as Special Counsel & Project Leader establishing Saudi Arabia’s first ADR Center.  Co-Founder & inaugural CEO, BCDR-AAA, innovations included Middle East Pre-Vis Arbitration Moot, Free Arbitration Zone and Statutory ADR Tribunals (claims USD $2Billion).  Extensive EMEA experience includes: Country Director, ABA Rule of Law Initiative’s judicial & legal reform, training officials, judges and lawyers in Bahrain, Jordan, Kuwait, Oman, Qatar, Saudi Arabia, Syria, UAE, and Morocco. Retained by World Bank, US Dept. of Commerce et al, training and advising ministers, MPs, business leaders and lawyers in negotiation, mediation and arbitration; advising governments and companies in EMEA and North America on ADR systems design, training and legislation. A successful mediator, including matters involving community, commercial, construction, financial, IP/Tech, indigenous disputes and organizational conflict.
